The European Gaming and Betting Association (EGBA) warmly welcomed the decision of Versailles’ French Court of Appeal in question of between French gaming legislation and European Union Law.
The court decision follows the request of the Ex-CEO of the gaming company authorized in Malta, Didier Dewyn, appealed to the court for the annual criminal proceedings to stop criminal actions filed against him last April 16, 2007. Dewyn was allegedly organizing an illicit lottery and secretly betting on horse races. In connection to this, the Court of Appeal is requesting additional information whether the French gaming system follows with the European Court of Justice’ case law.
During the press release, the EGBA said in a statement that the Court of Appeal of Versailles had called into question the compatibility of French gaming legislation with European law, setting the burden of proof on the French authorities to justify that their regulatory framework is consistent, proportionate and justified.
The decision of the Court of Appeal of Versailles was greatly pleased by the Secretary General of EGBA, Sigrid Ligne, which relies on the consistent proceedings of the European Court of Justice like in the critical case of Placanica ruling of March 6, 2007. In effect of that, the French authorities have the possibility in controlling of the opening of the French gaming market this coming March 2008.
